Trumbull County rapist’s conviction, life sentences upheld in appeal
The 11th District Court of Appeals in Ohio on Monday affirmed the convictions and two life sentences of Darrl A. Mack on multiple counts of rape and gross sexual imposition.
Mack, 26, was sentenced in April 2023 to consecutive prison terms of life without the possibility of parole by Trumbull County Common Pleas Judge Cynthia Rice after a jury found him guilty of three counts of rape and three counts gross sexual imposition.
The case involved the rapes of three female minors at an apartment in Warren during 2021.
Handling the state’s case at trial was Trumbull County Assistant Prosecutor Diane Barber.
In his appeal to the 11th District Court, Mack and his attorney raised nine assignments of error made by the trial court.
However, 11th District Judge Matt Lynch wrote that all defendant claims of trial errors were without merit.
Lynch was joined in the opinion by fellow 11th District judges John Eklund and Robert Patton.
Handling the appeal for the state was Trumbull County Assistant Prosecutor Ryan J. Sanders, while Mack’s lawyer at appeal was Eric M. Levy of Cleveland. The two lawyers made their arguments before the court in November 2023.
Mack will remain incarcerated at Belmont Correctional Institution.
