The Supreme Court of Ohio, in a majority decision on July 31, refused to take jurisdiction in the rape conviction of Kenneth Nitso, 35, of Hubbard.

Nitso is serving a 30-year to life sentence in Belmont Correctional Institution and had his appeal of the conviction and sentence in Judge Andrew D. Logan’s court denied by Ohio’s 11th District Court.

Justices Jennifer Brunner and Michael P. Donnelly wrote dissenting opinions in deciding whether to hear the appeal.

The indictment against Nitso stated he committed sexual acts against a girl under age 13 between May 2016 and May 2021.

After a trial, a Trumbull County jury in March 2023, convicted him of 10 out of 14 felony counts.
