Warren man loses appeal on cocaine conviction

The Ohio 11th District Court of Appeals on Monday affirmed the conviction and sentencing of LC Deshawn Harvey, 50, of Warren, who appealed his 12-month concurrent prison terms for possession of cocaine and attempted tampering of evidence convictions back in June 2023.

In an opinion written by 11th District Judge Robert J. Patton and affirmed by Judges Mary Jane Trapp and John J. Eklund, the court found that Common Pleas Judge Cynthia Rice was within the law in giving the concurrent sentences and that Harvey’s appeal was without merit.

“The trial court noted appellant’s (Harvey’s) prior prison sentences, his extensive criminal history, his prior failed attempts on community control sanctions, his numerous aliases, his multiple active warrants in several jurisdictions and his lack of remorse,” Judge Patton wrote in affirming the conviction and sentence.

Harvey is incarcerated in Marion Correctional Institution, serving a three-year prison term for another drug conviction in Trumbull County. He was represented in his appeal by attorney Michael Partlow of Stow, while Assistant Prosecutor Ryan J. Sanders represented the state.
